Warranty Information & License Agreement

Limited Hardware Warranty

Epipe Networks Pty. Ltd. ("ePipe") warrants this product to be in good working order and to be free from defects in workmanship and material (except in those cases where the materials are supplied by the Purchaser) under normal and proper use and service for the period of three (3) years from the date of original purchase from an Authorized Epipe Networks reseller. By registering your ePipe directly with Epipe Networks within thirty (30) days of the purchase date, Epipe Networks will offer free telephone support for the term of the warranty.

In the event that this product fails to be in good working order during the applicable warranty period, Epipe Networks will, at its discretion, repair or replace this product at the place of manufacture, at no additional charge other than the cost of freight of defective product to and from the Purchaser, provided such inspection discloses to Epipe Networks' satisfaction that the defects found are as above specified. Repair parts and replacement products will be provided on an exchange basis and will be either new or reconditioned. All replaced parts and products will be retained as the property of Epipe Networks. This manufacturer's warranty does not include service to replace or repair damage to the product resulting from accident, disaster, abuse, misuse, incorrect current, any non-Epipe Networks modification of the product except as provided or explicitly recommended by Epipe Networks, or other cause not arising out of defects in material or workmanship. This manufacturer's warranty also does not include service to replace or repair damage to the product if the serial number or seal or any part thereof has been altered, defaced or removed. If, after inspection by Epipe Networks, the product is not found to be defective, the Purchaser will be invoiced for said inspection and test at the then current repair charge, whether product is or is not in warranty.

If this product requires service during the applicable warranty period, a Return Materials Authorization (RMA) number must first be obtained from Epipe Networks. Product that is returned to Epipe Networks for service or repair without an RMA number will be returned to the sender unexamined. Product should be returned, freight prepaid, in its original or equivalent packaging, to an authorized Epipe Networks Service Centre. Proof of purchase date must accompany the returned product and the Purchaser shall agree to insure the product or assume the risk of loss of damage in transit. Contact an Epipe Networks regional office (addresses located elsewhere on this card) for further information.

It is expressly agreed by the Purchaser, in purchasing the products, that Epipe Networks' liability, if any, shall be limited solely to the replacement or repair of the product in accordance with the warranties specifically and expressly set forth herein. The remedies of the Purchaser are the exclusive and sole remedies available, and, in the event of a breach or repudiation of any provision of this agreement by Epipe Networks, the Purchaser shall not be entitled to receive any incidental damages as that term is defined in Section 2-715 of the Uniform Commercial Code. Epipe Networks waives the Benefit of any rule that disclaimer of warranty shall be construed against Epipe Networks and agrees that such disclaimers herein shall be construed liberally in favour of Epipe Networks.

Epipe Networks disclaims all warranties, express or implied, including any warranty of merchantability or fitness for a particular purpose.

Limitation of liability: No action, regardless of form, arising from the transaction(s) of this Agreement may be brought by either party more than two (2) years after the cause of action has occurred. The Purchaser agrees that in no event will Epipe Networks be liable for any damages, including lost profits, lost savings, or other incidental or consequential damages arising from the use of, or inability to use, such product, even if Epipe Networks or an authorized Epipe Networks reseller has been advised of the possibility of such damages. Also, Epipe Networks will not be liable for any claim by any other party. Epipe Networks' liability, if any, with respect to any claim arising from the Agreement, shall be limited to repair or replacement as provided in the Warranty.
